- Am I eligible for Government superannuation?
Many industrial or blue collar workers were informed that they were not eligible
to partake in the lucrative Government superannuation schemes. We have developed
extensive knowledge as to eligibility of such employees under the 1922 Superannuation
Act, the 1976 Superannuation Act (CSS) and the 1990 Superannuation Act (PSS). We
are able to advise Government employees and ex-Government employees as to their
eligibility under the scheme and to explain the complex legislative provisions and
rules associated with that.
- What is misleading conduct?
We have discovered that many Government employees and ex-Government employees wanted
to join the Government superannuation scheme but were advised that they were not
eligible. Many supervisors within the workplace had inadequate or incorrect knowledge
about eligibility but instead of making further enquiries, simply advised employees
that they were not eligible. In many cases, workers were denied many years of membership
of superannuation scheme and will therefore have a significantly lower payout upon
retirement.
- Have I been affected by incorrect advice?
It appears that the giving of incorrect information and the failure to properly
advise Government employees of their entitlements was spread across many workplaces
in Canberra and throughout Australia. The Commonwealth Government created various
statutory bodies, and it appears that many employees of those statutory bodies were
also misled or not provided with adequate information. All such employees have a
potential right to claim compensation.
- What is the legal process?
We are able to proceed with claims in Court where it is necessary, but also to explore
resolving matters by alternative dispute resolution. It is important to note that
many cases are affected by the Limitation Law, which restricts the time period in
which a claim can be lodged in the Court. We can advise you as to whether your claim
is within time and assist you to prepare the claim if that are necessary.
- What will this cost?
We are able to assess your matter and advice of your prospects without a financial
commitment from you. If the matter proceeds we will provide you with a detailed
Cost Agreement showing the way in which you will be charged. We will also advise
you as to what expenses will be incurred for any Court filing fee or any actuarial
calculations.
